Small businesses will only have to give one warning to an employee who is underperforming, according to details released of the Federal Government’s Fair Work Bill, proposed last week. Staff employed in the business for more than 12 months will require just one warning before an employer can terminate their employment.
Minister for Small Business Craig Emerson says the concession was important for small businesses that cannot sustain underperforming workers for as long as their larger counterparts. The concession means the three strikes policy does not apply. “No three written warnings, appropriately spaced over time, no legalistic processes,” he notes.
An employer can still dismiss an employee who has committed an illegal act such as theft, fraud or violence, immediately.
